A MAN threatened to put his girlfriend’s brother ‘in a body bag’ following an argument over a snake, six days after he was placed on a supervision order.

Malcolm Scott, of Davidson Place, Ayr assaulted the man on Christmas Eve when he attempted to punch him on the head and body at a house in Ayr.

On the same night Scott behaved in a threatening manner when he shouted, swore and uttered threats towards the man and woman. 

The 25-year-old appeared before Sheriff Mhari Mactaggart at Ayr Sheriff Court last week.

The court heard how the incident took place at 10.30pm when the witness was with her brother.

Depute Fiscal Claire McEvinney said: “They heard the front door being opened and went down to see who was there. 

"Scott had entered the property intoxicated and was standing in the hallway.

“They tried to usher him out but Scott started kicking the door before uttering various threats. 

“He shouted ‘I am going to stab you, I am going to put you in a f***ing body bag’.

“The woman called [to] her brother for help who attended but Scott continued to make threats and told them he had a knife. 

“He said ‘I am going to stab you and slit your throats’.

“He ran towards the man, throwing a punch at his face but missed.

“He threw a punch at his glasses but they managed to restrain him. Police were called and the witnesses told him about the knife but no knife was recovered.”

Sheriff Mactaggart said: “This happened six days after he was put on an order.”

Speaking on his behalf, defence solicitor, Mandy Stewart said: “It did and Mr Scott accepts this was completely unacceptable.”

Sheriff Mactaggart replied: “It certainly was.”

Ms Stewart added: “It was all about a pet snake. Mr Scott accepts responsibility for the assault. This was not self defence and he accepts he drank far too much that night.

“He assaulted his partner’s brother. A reconciliation is planned. I think supervision would benefit him. He has attended shifts for his unpaid work and had confirmed he is willing to do more hours.”

Addressing the dock, Sheriff Mactaggart, said: “Do you understand the real difficulty you have put yourself in? You committed this offence six days after appearing in front of me. What do you think I think?”

Scott replied: “Not a lot.”

Sheriff Mactaggart continued: “If you go out the door and complete another offence within a short period of time you will go to jail.”

Scott has been placed on a community payback order for 12 months ans will complete 120 hours unpaid work within nine months.
