A KILBIRNIE man has been jailed after he was found with over 1,000 diazepam tablets in his possession.
Henry Wilbraham, 35, of Barney Terrace, appeared for sentencing at Kilmarnock Sheriff Court last week after background reports were called for.
The court heard how he had been found at a property in Newton Street, Kilbirnie with 1,026 tablets with a value of £1 each.
Wilbraham was also found with three 100g wraps of cannabis resin worth £180 after police carried out a search warrant.
And after the items were recovered, he stated “It’s not illegal”.
He also admitted a charge of failing to appear at an undertaking at Kilmarnock Sheriff Court.
Ms Crilly, defending, said that her client was living with his father at the time and he accepts that his behaviour was
"totally unacceptable".
She said: “He does appreciate he was concerned in the supply of drugs but it was in social supply for friends.
“He’s managed to remain out of trouble for the last three years but has a substantial record.
“He clearly has addiction issues when it comes to cannabis and is eager to accept any help the court can suggest.
“He’s a family orientated
man, helps his father and hopes to restart a relationship with his children in the Borders
and wants to travel down to
visit them.
“He’s utterly embarrassed about his behaviour.”
Sheriff Alistair Watson said: “Having regard to the report it’s true that you’ve been out of trouble.
“The problem you have is that you’ve got a terrible record for supplying or intent to supply. There is no alternative but to impose a custodial sentence here."
Wilbraham was sentenced to a total of 10 months on all three charges.
