A MAN has been jailed for four months after subjecting two pensioners to abusive threats in Dalry while he was on bail and subject to an ASBO.

Christopher Brown, who is currently serving a 22-month sentence at HMP Kilmarnock, appeared from custody at Kilmarnock Sheriff Court last week and pled guilty to one charge.

The court heard that at around 3pm on March 27, a 72-year-old man was selling his car from his driveway and was accompanied by a 70-year-old man.

The pair were talking about the car when Brown, 29, walked past with two other men.

Brown started to shout at both pensioners in the driveway.

He called one of the elderly men “a pervy old b******” and said that he was going to “get done in” and that his windows were going to “get done in”.

Brown then shouted to the other elderly man: “F****** speccy”.

The abuse lasted about five minutes before Brown and his friends walked away.

Police were contacted and the court heard that when Brown was arrested, he said: “No comment.”

Defending Brown, solicitor Mr Robertson said that his client was serving 22 months imprisonment at Kilmarnock Prison and that he was due to be released on February 28 next year.

Mr Robertson added that whilst his client has been in jail, he has been attending courses for addiction, specifically for alcohol.

He told Sheriff Elizabeth McFarlane: “Her Ladyship will see that there’s a gap in his record. He was in full time employment as a scaffolder but then he was made redundant and his relationship broke up and he went in a downward spiral.”

Sentencing Brown, Sheriff McFarlane said: “Mr Brown, I’m going to give you four months, reduced from six months.

“I’m not giving you any additional penalty for the fact you were on an ASBO and on bail at the time.”

Brown’s sentence will run concurrently with his current prison term.
