AN ACCUSED person facing assault and threatening behaviour charges told a court they had the wrong man after accidentally appearing in the dock for a different case.

Daniel Keay, 32, had to raise his hand and point out the error halfway into the hearing, after thinking the court called out his surname.

Meanwhile a warrant had to be issued for Daniel Thwaite who failed to appear in the dock on other matters – after Mr Keay pointed out the mix-up having taken a telling off from the other accused’s lawyer for failing to provide documents for legal aid payments when believing him to be his client.

Mr Keay, previously of Laburnam Avenue, Beith and now Ibrox, Glasgow, faces a charge of assault and two counts of behaving in a threatening or abusive manner likely to cause fear and alarm.

The complaint states Mr Keay shouted, swore and uttered threats during an incident on November 6, 2019 at an address in Glebe Road, Beith.

It’s alleged that during an incident on November 4 at the same address he assaulted a female by spitting in her face and hair.

After establishing the court had “the right Daniel this time”, the Sheriff adjourned the case for two weeks.
